Website Terms Of Use
Last updated: 23 September 2026
Please read these terms before using www.arcanaliving.com. They explain the rules that apply when you browse or use our website.
These Website Terms of Use apply to use of the website itself. We currently sell and ship to the United Kingdom only. If you place an order, our Terms and Conditions of Sale (our Terms and Conditions) and our Delivery & Returns Policy also apply to that purchase. Our Privacy Policy explains how we use personal information, and our Cookie Policy explains how we use cookies and similar technologies. Purchases made through third-party marketplaces such as Etsy, or through our wholesale arrangements, are covered by separate terms and privacy information.

2. Using the Website
You may use the Website only for lawful purposes and in accordance with these terms. By using the Website, you confirm that you accept these terms and agree to comply with them. If you do not agree to these terms, you should not use the Website.
You must not:
-
use the Website in a way that breaches any applicable law or regulation, is fraudulent, or has an unlawful or fraudulent purpose or effect;
-
use the Website to harm or attempt to harm a child;
-
send unsolicited or unauthorised advertising, promotional material or similar communications through the Website;
-
knowingly introduce viruses, trojans, worms, logic bombs, spyware or other harmful or malicious material;
-
attempt to gain unauthorised access to the Website, its server, or any server, computer or database connected to it;
-
attack the Website through a denial-of-service or distributed denial-of-service attack;
-
interfere with the Website's security, operation or access controls;
-
use automated means to scrape, harvest or systematically extract Website content or data without our written permission; or
-
impersonate another person, provide deliberately false information, or misuse our customer-support services.
We may restrict or suspend access where we reasonably believe this is necessary to protect the Website, its users or our rights, or because these terms have been seriously or repeatedly breached.
Some of the conduct prohibited above - for example knowingly introducing malicious material, attempting to gain unauthorised access to the Website or its servers, or carrying out a denial-of-service attack - may be a criminal offence under the Computer Misuse Act 1990.
3. Availability and changes
The Website is made available free of charge, although products offered through it must be paid for unless expressly stated otherwise. We currently sell and ship physical and standalone digital products to customers in the United Kingdom only, and we do not currently accept orders for delivery or supply outside the United Kingdom.
We may update the Website and its content from time to time. We do not guarantee that the Website, or any particular part of it, will always be available or uninterrupted. We may suspend, withdraw or restrict availability for maintenance, security, operational or other reasonable purposes.
We will try to give reasonable notice of a significant planned suspension where practicable. We are not responsible for interruptions caused by matters outside our reasonable control, but this does not affect any responsibility we have for an order you have already placed.
4. Accounts and security
If you create an account or receive login or access information, you must keep it confidential and must not knowingly allow another person to use it without authority.
You are responsible for providing accurate information and keeping your contact details up to date. Please tell us promptly at care@arcanaliving.com if you believe that someone has accessed your account or knows your password without permission.
We may disable an account or access credential where we reasonably believe it has been compromised, used unlawfully or used in serious or repeated breach of these terms. Where appropriate, we will explain what has happened and how to contact us.
5. Children and family use
Orders, subscriptions, downloads and Website accounts must be made or held by an adult aged 18 or over.
Some Website content and products - including our Curiosity Companions subscriptions (Curiosity Crew, designed for children aged approximately 4-7, and Curiosity Club, designed for children aged approximately 7-12), together with certain archive editions and standalone digital education products - are designed for children to enjoy with their families. The subscription account and contract are always held by an adult. A parent or other responsible adult should decide whether content or an activity is appropriate for a particular child and provide involvement or supervision where indicated or appropriate.
The Website and its content are not a substitute for an adult's assessment of a child's abilities, health, surroundings or the conditions in which an activity will take place. Product-specific and activity-specific safety instructions should always be followed.
Some products, packages and activities are intended for particular age ranges and may contain small parts or components that could pose a choking or other hazard to young children. You should always read and follow the age guidance, warnings and safety instructions shown on the packaging, insert or product page, keep unsuitable items away from younger children, and provide supervision appropriate to the child and the activity. Where product-specific safety information differs from general Website content, the product-specific information takes precedence.
6. Intellectual property
We are the owner or licensee of the intellectual-property rights in the Website and the material published on it, including text, illustrations, photographs, designs, logos, graphics and downloadable material. Those works are protected by copyright, trade-mark and other intellectual-property laws. All rights are reserved.
You may view the Website and print or download reasonable extracts of freely available Website pages for your personal, non-commercial use. You may share a link to a Website page, provided you do so fairly and lawfully and do not suggest an association with or endorsement by us where none exists.
Unless we give written permission or the law expressly permits it, you must not:
-
reproduce, republish, sell, license or commercially exploit Website content;
-
modify copies of Website content or remove copyright, trade-mark or ownership notices;
-
use illustrations, photographs, video, audio or graphics separately from any accompanying text where doing so would infringe our or another person's rights; or
-
upload our content to another website, shared drive, platform or database for distribution to others.
Purchased digital products are governed by the personal household licence in our Terms and Conditions and any additional licence stated on the relevant product page. These Website Terms do not give you additional rights to use or share a purchased digital product.
If you use Website content in serious breach of this section, your permission to use that content ends. We may ask you to delete or return infringing copies, without affecting any other rights or remedies available to us.
7. Information and educational content
We take reasonable care when preparing Website content, but material provided free of charge is for general information and educational interest. It should not be treated as professional, medical, veterinary, legal or other specialist advice.
Nature, wildlife and outdoor conditions can change. Before relying on information for an activity, an adult should consider current local conditions, official guidance, weather, access restrictions and the needs of the people taking part.
Some Website content describes outdoor, nature and foraging activities that carry inherent risks. Do not touch, pick, taste or eat any plant, fungus, berry or other natural material on the basis of Website content unless a responsible adult has confirmed it is safe and correctly identified and always check for allergies and follow local rules on access and wildlife. An adult should supervise children during any outdoor or nature activity and assess the risks for the particular child, location and conditions.
Nothing in this section reduces our obligations concerning the description, quality, fitness, safety or supply of a product you buy from us. Those matters are addressed in our Terms and Conditions and your statutory rights.
8. Third-party links
The Website may contain links to websites, services or resources provided by third parties. These links are provided for information or convenience. A link does not necessarily mean that we endorse the third party or everything on its website.
We do not control third-party websites and are not responsible for their content, availability or privacy practices. You should review the terms and privacy information that apply when you visit them.
If a link is an affiliate link or we may receive a benefit from it, we will identify this where required.
9. Linking to the Website
You may link to our home page or another publicly available page in a way that is fair and lawful and does not damage our reputation or take advantage of it.
You must not create a link that suggests an association, approval or endorsement where none exists, frame the Website on another website, or link from a website that contains unlawful content. We may withdraw linking permission where reasonably necessary.
10. Viruses and technical security
We take reasonable steps to operate the Website securely, but we cannot guarantee that it will always be secure or free from bugs, viruses or other harmful material. You are responsible for using appropriate security and virus-protection software on your device.
Nothing in this section limits any responsibility that the law does not allow us to exclude.
11. Our responsibility
These provisions concern free use of the Website. Our responsibility for products, subscriptions and purchased digital content is governed by our Terms and Conditions and applicable consumer law.
If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable or for business losses arising from consumer use of the Website.
If you use the Website for business purposes, then, so far as the law permits, we are not responsible for loss of profit, sales, business, revenue, anticipated savings, business opportunity, goodwill or reputation, or for indirect or consequential loss arising from your use of or inability to use the Website or reliance on its free content.
Nothing in these terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory rights or product liability that cannot lawfully be excluded.
12. Personal information and cookies
Arcana Living Ltd is the controller of the personal information we collect through the Website. We use personal information as explained in our Privacy Policy, which reflects our obligations under the UK GDPR and the Data Protection Act 2018. Our Cookie Policy explains how cookies and similar technologies are used and how you can manage your choices.
The Privacy Policy provides information about our processing; it is not a contract that you are required to accept merely by browsing the Website. Where the law requires consent for a particular use of information or technology, we will ask for that consent separately.
13. Changes to these terms
We may update these Website Terms from time to time, for example to reflect changes to the Website, our practices or the law. The date at the top shows when they were last updated.
Any revised terms apply from publication to subsequent use of the Website. A change to these Website Terms will not retrospectively alter the terms governing an order already placed.
14. General
If a court or relevant authority finds that part of these terms is unlawful or unenforceable, the remaining provisions will continue to apply.
No person other than you and us has a right to enforce these terms.
If we delay enforcing a provision, that does not mean that we have waived our right to enforce it later.
We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if this happens and will ensure that the transfer does not affect your rights under these terms.
15. Governing law and disputes
These Website Terms are governed by the law of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections of your home jurisdiction and may bring proceedings in the courts available to you under applicable law.
If you are a business, the courts of England and Wales have exclusive jurisdiction over disputes relating to these Website Terms.
